Terms and Conditions

You indicate acceptance of these terms and conditions of service by placing an order with Site-Street Ltd. These terms and conditions will not be varied for individual customers. “Site-Street” refers to Site-Street Ltd.

Terms of Service

Site-Street provides World Wide Web page hosting. Site-Street reserves the right to suspend or cancel a customer’s access to any or all services provided by Site-Street when Site-Street decides that the account has been inappropriately used or otherwise.

Server Use

Site-Street reserves the right to refuse service and/or access to it’s servers to anyone.

Site-Street does not allow any of the following content to be stored on its servers:

Illegal Material – This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation.

Adult Material – Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of “adult material” is left entirely to the discretion of Site-Street.

Warez – Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide “links to” or “how to” information about such material.

Payment Policies

All accounts are set up on a prepay basis, either monthly or annually. Site-Street does not charge a setup fee for new accounts. All pricing is guaranteed for the term of prepayment. Site-Street reserves the right to change prices at any time. Payment is due each anniversary month or year following the date the account was established. No bills or invoices will be sent by regular mail. Invoices for those customers who pay by cheque will be sent via e-mail 1-2 weeks before payment is due. The customer is responsible for all money owed on the account from the time it was established to the time that the customer notifies Site-Street in writing for a request for termination of services. All payments are in U.K. Pound Sterling (£).

We accept payment by credit card so non-UK customers can pay using their local currency and accounts can be setup much faster.

Cancellation

Site-Street reserves the right to cancel service at any time. All fees paid in advance of cancellation will be prorated and paid by Site-Street if Site-Street institutes its right of cancellation. If cancellation is caused by customers violation of these policies, then no refund is due. Customers can cancel service any time and be refunded any amount exceeding the prepayment of the current term. Payment will be made by company cheque within 30 days of receipt of cancellation. The account will be cancelled at the end of the current billing period, unless a date of cancellation is specified.

Indemnification

The customer agrees that it shall defend, indemnify, save and hold Site-Street harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against Site-Street, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Site-Street against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Site-Street’s server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Site-Street’s server.

Disclaimer

Site-Street will not be responsible for any damages your business may suffer. Site-Street makes no warranties of any kind, expressed or implied for services we provide. Site-Street disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Site-Street and its employees. Site-Street reserves the right to revise its policies at any time.

Acceptable Use Policy

The Internet is a powerful information and entertainment tool, we would expect our customers to use the Internet with respect, courtesy, and responsibility, giving due regard to the rights of other Internet users.

Our acceptable use policy is actively and strictly enforced. Offending content or users are removed from our network, usually as soon as they are discovered, although we will always inform you when and why any action has been taken.

Common sense is the best guide as to what is considered acceptable use, however the following are unacceptable uses.

Illegality

In any form, including but not limited to the unauthorised distribution or copying of copyrighted software or other data, harassment, fraud, trafficking in obscene material.

Undesirable Content

Certain types of content are not allowed on our network. We do not host adult content of any description. Content relating to Hacking, Cracking, Warez and IRC is not allowed. Software downloads may only be hosted if you are the writer and copyright owner of the software, all other software including freeware, shareware and trial software is forbidden. Audio and video downloads may only be hosted if you are the creator and copyright owner of the work.

Bulk Email

The use of our network to send bulk email whether opt-in or otherwise, and the use of bulk email to promote a site on our network is strictly forbidden.

Misuse of Resources

Including but not limited to employing applications which consume excessive CPU time, memory or storage space. Chat/IRC, web proxy and mailing list scripts are not allowed on our network under any circumstances. Streaming media can be a drain on web server resources and as such is not allowed. CGI based message forums which use flat file databases are often found to use excessive system resources, to avoid disappointment please use a PHP/ASP message forum.

If you are unsure about content you intend to place on our network, please check with us before you do. We reserve the right to determine what constitutes acceptable use.
